General Recording Requirements
The Recorder is required to record all documents submitted by the public which are qualified to be recorded. An instrument which fails to meet any of the conditions, as defined by Utah State Code, may be rejected for recordation at the time of presentation. Prerequisites for documents to be recorded in the Office of the Recorder, Duchesne County, Utah:
Original Document, or Certified Copies, unless otherwise provided by law: Documents must be originals with original signatures and dated notary acknowledgment with notary stamps and/or seals to be eligible for recording. Documents submitted for recording shall be on separate sheets of white paper, letter size (8-1/2 inches by 11 inches), have a margin of one inch on the left and right sides and at the bottom of the page, have a space of 2-1/2 inches down and 4-1/2 inches across the upper right corner of the first page and a margin of one inch at the top of each succeeding page. Legibility: Documents shall be clearly readable, be printed in black ink, be in English or be accompanied by an accurate English translation, and not have text smaller than seven lines of text per vertical inch, (font size of 12 is sufficient), Names of Signers and /or Companies shall be typed or clearly printed. Return Address: Documents affecting title to real property shall contain the correct mailing address of the grantee. Nature of Document: Documents shall contain a brief caption stating the nature of the document. Legal Description: Document shall have a complete and correct legal description of the property affected. (Utah Code 57-3-105) Tax Parcel Number / APN : Applicable tax parcel number of each parcel described in the instrument shall be noted on the document. All instruments to be recorded which will affect surface properties must have parcel numbers for each parcel. (Parcel Numbers will not substitute for legal descriptions.) (Utah Code 17-21-20(4a)
Fees for recording documents which do not comply with requirements will be $2.00 per page.
